N76bn Fraud Trial: Court Admits AMCON Board Resolutions Proving Arik Receivership Was a Corporate Decision

The Special Offences Court sitting in Ikeja, Lagos, has admitted Asset Management Corporation of Nigeria (AMCON) board resolutions as evidence in the ongoing N76 billion fraud trial. The documents counter claims that Ahmed Kuru, the corporation’s former managing director, unilaterally approved the receivership of Arik Air.

Presided over by Justice Mojisola Dada, the court admitted the documents on Monday when they were tendered by defence counsel Uyi Giwa-Osagie during the cross-examination of the fourth prosecution witness, Bawa Usman Kaltungo.

Kaltungo, an investigator with the Economic and Financial Crimes Commission (EFCC), had earlier maintained that Kuru—the second defendant and former AMCON chief executive—wielded unfettered powers and sanctioned the airline’s takeover alone.

Although the prosecution objected to the relevance and admissibility of the records, the court admitted them to establish that the receivership was a collective corporate decision.

The EFCC is prosecuting the defendants following a petition filed by Femi Falana on behalf of Arumemi-Ikhide. Other defendants joined in the suit include Kamilu Omokhide (former receiver-manager of Arik Air), Roy Ilegbodu (airline CEO), Union Bank Plc, and Super Bravo Limited.
