The Federal High Court in Abuja on Monday dismissed an application by Omoyele Sowore, presidential candidate of the African Action Congress (AAC), seeking an order compelling the Director-General of the Department of State Services (DSS), Oluwatosin Ajayi, to testify in his defence in an ongoing case involving alleged cybercrime.
Justice Mohammed Umar, who delivered the ruling, held that granting the application would not serve the interest of justice. The judge stated that the DSS Director-General or another designated officer with full knowledge of the agency’s official activities and other relevant matters could testify on Sowore’s behalf.
Sowore, through his counsel, Adeyinka Olumide-Fusika, SAN, had asked the court to compel Ajayi to appear personally as a defence witness in the case.
The DSS, through its counsel, Akinlolu Kehinde, SAN, opposed the application, arguing that the Director-General did not have to appear personally when another qualified official of the agency could provide the necessary testimony.
The case stems from allegations that Sowore published posts on X, formerly Twitter, and Facebook in August 2025, describing President Bola Tinubu as a “criminal” and accusing him of misrepresenting the level of corruption in the country.
The DSS is prosecuting Sowore over the publications, which form the basis of the ongoing proceedings.
