Court Restrains EFCC From Arresting Over 200 Honda Executives, Dealers and Associates Pending Investigation

A Lagos State High Court has issued an interim order barring the Economic and Financial Crimes Commission (EFCC) from arresting, detaining, or harassing over 200 applicants, including executives, dealers, distributors, and business associates of Honda Manufacturing (Nigeria) Limited and Honda Automobile Western Africa Limited.

Justice Olukayode Ogunjobi granted the protective order following an application filed by the applicants’ counsel, Chief Bolaji Ayorinde, SAN, amid an ongoing anti-graft investigation.

Key Highlights of the Order:

  • Scope of Protection: The interim injunction shields more than 200 individuals and corporate entities linked to Honda’s operational and distribution network across the country from any form of coercive executive action.
  • Grounds for the Application: The legal team instituted the fundamental rights action under the 1999 Constitution and the African Charter on Human and Peoples’ Rights, arguing that continuous invitations and threats of detention violated the applicants’ personal liberty and freedom of movement.
  • Substantive Hearing: The court preserved the status quo by restricting law enforcement interference pending the determination of the substantive suit, with further hearings scheduled for subsequent dates.
