A Federal High Court in Lagos has granted Nollywood actress Doris Ogala bail in the sum of ₦30 million with two sureties in like sum over alleged cyberstalking and other offences involving Pastor Chris Okafor.
Justice Akintayo Aluko granted the bail on Friday, November 6, directing the actress to surrender her international passport to the court registrar.
The judge also restrained Ogala from making electronic publications capable of harassing, threatening or intimidating prosecution witnesses.
In his ruling, Justice Aluko said the court had to balance the defendant’s constitutional right to liberty with the need to protect witnesses and preserve the integrity of the trial.
The judge expressed concern over Ogala’s conduct during proceedings on October 28, which he said disrupted the court’s sitting and led to the adjournment of 10 cases. He noted, however, that she had apologised for her conduct.
Justice Aluko stressed that the actress remained presumed innocent under the Constitution.
The prosecution had opposed the bail application, alleging that Ogala failed to attend earlier proceedings in April and June, citing ill health. It also expressed concern that she could use social media to harass or intimidate witnesses.
The defence argued that the offences were bailable and that the actress would not evade trial or interfere with witnesses.
Ogala was arraigned on October 28 on three counts bordering on alleged cyberstalking, cyberbullying and attempted extortion involving Okafor. She pleaded not guilty and was remanded pending the determination of her bail application.
Under the bail conditions, Ogala is required to provide two sureties in like sum. One must either own registered property in Lagos or be a prominent national officer of her political party or a person of recognised standing.
The sureties must reside within the court’s jurisdiction, provide tax clearance certificates covering three years and undergo verification by the court registrar.
The actress was also directed to swear an undertaking to maintain good conduct throughout the trial.
Her lawyer, Marshal Abubakar, told the court that Ogala was receiving treatment at General Hospital, Ajegunle, following surgery.
The judge ordered her release from custody upon fulfilment of the bail conditions.
