A Federal High Court sitting in Abuja has dismissed a ₦10 billion fundamental rights suit filed by veteran Nollywood actor Emeka Ike against Lere Olayinka, a senior aide to the FCT Minister, and the Independent National Electoral Commission (INEC).
Justice Salim Ibrahim threw out the case after upholding the preliminary objections raised by the respondents, ruling that the suit was incompetent, improperly constituted, and lacked sufficient proof.
Key Highlights of the Ruling:
- The Core Dispute: The litigation stemmed from a social media post made by Olayinka, which displayed details of the actor’s voter registration transfer from Imo State to Abuja. Ike contended that the disclosure violated his right to privacy and data protection.
- INEC and Defense Positions: Both INEC and the defense maintained that the material in question did not compromise the commission’s secure databases and that the published information was already publicly accessible, leading the court to hold that the applicant failed to establish a statutory breach.
- Dismissal Grounds: Justice Ibrahim ruled that the applicant failed to substantiate his claims against the respondents, ultimately throwing out the ₦10 billion damages demand.
