
STATEMENT BY AARE OLUMUYIWA AKINBORO, SAN ON THE EFFURUN INCIDENT.
The recent incident in Effurun, Delta State, involving the death of a young man, reportedly identified as Mene Ogidi, is deeply troubling and calls for sober reflection within the framework of the law. My thoughts are with his family at this difficult time.
The right to life, as guaranteed under the Constitution of the Federal Republic of Nigeria, remains one of the most fundamental protections afforded to every citizen. It is a right that places a corresponding obligation on all state actors, particularly law enforcement agencies to act within clearly defined legal boundaries in the discharge of their duties.
The use of force by security personnel is not without limits. It is regulated, guided, and must always be exercised with restraint and in strict adherence to established legal and operational standards.
Where a suspect has been subdued and no longer poses an immediate threat, the justification for lethal force becomes highly questionable.
It is therefore important that the circumstances surrounding this incident are subjected to a thorough, transparent, and impartial investigation. The assurances already given by the relevant authorities are noted. However, beyond initial responses, what is required is a process that reflects the seriousness of the issues involved and reinforces public confidence in the justice system.
Accountability, when necessary, must follow due process. It is through this process that the integrity of our institutions is preserved and the rule of law strengthened.
At moments such as this, it is essential that we resist the pull of speculation and allow the law to take its full course. The responsibility rests on all stakeholders to ensure that justice is not only pursued, but is seen to be pursued in accordance with the law.
Ultimately, the strength of any legal system lies not only in the laws it proclaims, but in the discipline with which those laws are applied.
