ABSTRACT
Many considerations come to mind in determining whether copyright subsist in an intellectual creation, the most important is to ascertain whether the work falls under what is covered by the Copyright Act (“the Act”). For a work to enjoy protection under the Act, such work must either be a literary, musical works, artistic works, cinematograph films, sound recordings, or broadcasts. This paper is a critical examination of the subject matter of copyright; the conditions a work must meet to be eligible for copyright; and whether fixation and originality are at all required for copyright protection. The paper would also examine the connection of copyright to Nigeria in relation to other countries of the world.
Finally, the paper would conclude with recommendations on possible reviews that can be made to meet the current trends of development.
