Court Fixes Dec 1 To Rule On Alleged Contempt Filed By Rite’s Food Against NBC

 

Justice Ambrose Lewis-Al­lagoa of a Lagos Federal High Court on Monday, fixed December 1, 2021 for ruling on the application filed by Nigerian Bottling Company (NBC) application to dismiss the contempt suit filed by Rite Foods against NBC and its Managing Director, Mat­thieu Seguin over alleged trademark infringement.

Justice Allagoa fixed Decem­ber 1, 2021 after listening to the arguments canvassed by the counsel to parties in the suit.

The legal tussle started when RiteFoodsfiledthecontemptsuit againsttheManagingDirectorof the Nigerian Bottling Company (NBC) and Mathieu Seguin.

Counsel to NBC’ MD, Mr. Oluseye Opasanya (SAN) at the resume of the proceed­ings informed the court that he filed motion on notice dat­ed October 18 supported with seven paragraph affidavit to­gether with one exhibit.

Opesanya (SAN) told the court that he brought mo­tion to strike out the suit on a number of reasons.

They alleged that the con­tempt proceedings should stop because interim order of February 9, 2021 against NBC had been discharged by Hon. Aneke. NBC’s counsel, Ngo-Martins Okonmah with Farida Ali first argued NBC’s application.
